Recovery Momentum Academy™ and Recovery Momentum Index™ · Effective June 1, 2026

1. Agreement to These Terms
By accessing our websites, submitting an enquiry, enrolling in a certification program, or licensing the Recovery Momentum Index™, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
These terms apply to recoverymomentumacademy.com and recoverymomentumindex.com, operated by Stephen Nemetchek, CPRC (IAPRC), British Columbia, Canada.
2. Our Services
We offer two categories of service:

Recovery Momentum Academy™ certifications: Online professional certification programs for recovery coaches, delivered in a hybrid format (self-paced content plus weekly live sessions).

Recovery Momentum Index™ licensing: Annual licenses granting treatment programs and organizations the right to use the RMI™ measurement framework, subject to the terms in Section 4.
3. Enrolment and Payment, Academy
Enrolment
Enrolment in a certification program is confirmed upon receipt of full payment (or first installment of a payment plan). Enrolment is personal and non-transferable.
Payment
Payments are processed securely through Stripe. All prices are in Canadian dollars (CAD). By completing payment, you authorize the charge to your payment method.
Payment plans
Where a payment plan has been agreed in writing, each installment is due on the agreed date. Failure to make a scheduled payment may result in suspension of access until payment is received.
Refunds
Please refer to our Refund and Cancellation Policy for full details. Full refunds are available within 7 days of enrollment if you have not accessed course materials.
Course access
Upon enrolment, you receive access to the self-paced course content for the duration of the program. Live session recordings remain accessible for 90 days after the final session.
4. RMI™ Licensing Terms
License grant
An RMI™ license grants your organization a non-exclusive, non-transferable, revocable right to use the Recovery Momentum Index™ framework within your licensed program for the term of the agreement.
Restrictions, you may not:

Sublicense, resell, redistribute, or share RMI™ framework materials with parties outside your licensed organization

Remove or modify the Recovery Momentum Index™ name, trademark, or attribution

Represent the RMI™ as your own framework or rebrand it under another name

Use the RMI™ in publications, research, or commercial training materials without prior written consent

Train staff at organizations outside your licensed entity without upgrading to an appropriate Enterprise license
License fees
License fees are as agreed in writing prior to commencement. Unpaid licenses may be suspended or terminated with 14 days written notice.
5. Intellectual Property
The Recovery Momentum Index™ framework, the Recovery Momentum Academy™ curriculum, all course materials, workbooks, vignettes, scoring tools, brand names, logos, and website content are the exclusive intellectual property of Stephen Nemetchek, protected by Canadian and international copyright and trademark law.
RMI™ and Recovery Momentum Index™ are trademarks. Unauthorized use is prohibited.
Enrolment or licensing does not transfer any ownership rights. Upon graduation, students receive an RMA™ credential, this certifies completion of the program but does not confer any rights to the RMI™ framework beyond curriculum use.
6. Acceptable Use
You agree to use our services only for lawful professional purposes. You must not:

Share your course login credentials with others

Record, reproduce, or distribute live session content without written permission

Misrepresent your credentials, organization, or professional role when enrolling

Use course materials or the RMI™ framework in a manner that could cause harm to individuals in recovery

Claim that RMA™ certification constitutes clinical licensure, medical qualification, or ICF accreditation
Violation of acceptable use terms may result in immediate termination of enrollment or license without refund.
7. Clinical and Medical Disclaimer
Important: The Recovery Momentum Index™ is a coaching and measurement framework, not a diagnostic tool, medical device, clinical assessment instrument, or substitute for professional clinical judgment. It does not diagnose addiction, mental illness, or any medical condition. RMA™ certifications are professional development programs, they do not confer clinical licensure, medical qualification, or authority to provide clinical treatment.
Any reference to “relapse risk” within our materials refers to coaching-level awareness to support appropriate referral and program responses, not a clinical prediction or medical prognosis. Coaches are expected to work within their scope of practice and to refer to licensed clinical professionals when clinical intervention is indicated.
We make no representations that use of the RMI™ framework will prevent relapse, ensure treatment success, or produce any specific outcome for any individual in recovery.
8. Credentials and Certification
RMA™ credentials are issued by Recovery Momentum Academy™ upon successful completion of all program requirements. They represent completion of an independently certified professional training program.
RMA™ certifications are independently certified and are not currently accredited by the International Coaching Federation (ICF). Curriculum is designed to align with ICF Core Competency standards. ICF Level 1 institutional accreditation is a planned future milestone.
The founder holds the CPRC credential through IAPRC (International Association of Professional Recovery Coaches), recognized by NAADAC. RMA™ programs are designed to qualify for IAPRC continuing education recognition.
9. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Our total liability for any claim arising from our services shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.
10. Termination
We may suspend or terminate your access to our services if you breach these terms, with or without notice depending on the severity. You may cancel your enrollment at any time, subject to our Refund Policy. License holders may terminate an annual license with 30 days written notice; prepaid fees are non-refundable unless otherwise specified.
11. Disputes and Governing Law
These terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved first through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in British Columbia, except that either party may seek injunctive relief to protect intellectual property rights.

Changes to these terms: We may update these Terms from time to time. Material changes will be communicated by email to enrolled students and licensed organizations. Continued use after the effective date constitutes acceptance.
